In a proposed show-cause notice, the Maharashtra FDA referred to Section 24 of the Food Safety and Standards Act, 2006, which places restrictions on food-related advertisements and prohibits misleading advertisements and unfair trade practices in violation of the Act and the rules and regulations framed under it.
According to the notice, an advertisement relating to “VIMAL” Elaichi has been circulated through various media platforms. The FDA has sought an explanation from the three actors regarding their alleged participation in, endorsement of, or promotional association with the advertisement.
The notice asks the actors to clarify the nature and extent of their involvement, the capacity in which they appeared in the promotional material, and whether their participation was based on any contractual or other arrangement.
The FDA has indicated that the matter is being examined under the provisions of the Food Safety and Standards Act, 2006, and the applicable rules and regulations.
The actors have been called upon to provide their explanations to the authorities. Further action, if any, would depend on the responses received and the findings of the competent authority.
The allegations contained in the proposed notice are subject to the actors’ responses and any subsequent proceedings by the authorities.
